Directory Terms of Use     

This document use sets out the terms between you and the Teaching School Hub Portal under which you may access our website www.tshubportal.org and www.teachingschoolhubportal.org (our site). Our Terms and Conditions apply to all users of, and visitors to, our site.

Your use of our platform's directort means that you accept, and agree to abide by our terms and conditions.

In using the directory you agree to the following:

SECTION 1 : Prohibited Directory Submissions

  1. Without prejudice to our other rights under these terms and conditions, we reserve the right to reject or delete submissions that breach these terms and conditions, or that do not meet our guidelines for submissions published on our website.
  2. If we reject or delete a submission in accordance with this Section 1, we reserve the right not to provide access to further listing entries in the future.

SECTION 2 :Advertising and the Promotion of Services

  1. You must not promote any product, service that is not educationally focused.
  2. All listings must not 

                (a) breach any laws, regulations or codes;

                (b) infringe any third party intellectual property rights or other legal rights; or

                (c) give rise to a cause of action against any person, in each case in any jurisdiction and under any applicable law.

  1.  Listing entries submitted to our website must not be for any product, service or other subject matter that:

                (a) consists of or contains material that would, if published on our website by you, contravene the provisions of Section 18;

                (b) is or relates to:

                        (i) drugs, narcotics, steroids or controlled substances;

                        (ii) obscene, indecent, pornographic or sexually explicit materials;

                        (iii) knives, swords, firearms or other weapons;

                        (iv) ammunition for any weapon;

                        (v) items that encourage or facilitate criminal acts or civil wrongs; or

                        (vi) items that encourage or facilitate the infringement of any intellectual property right;

  1. Your listing must comply with the requirements of Section 1 and Section 2.
  2. You grant to us a worldwide, non-exclusive, royalty-free licence to publish your listing on our website, and to copy, alter and store your advertisements in connection with their publication on our website, together with the right to sub-license these rights.
  3. You agree to keep your listing up to date and agree to advise us if you wish us to remove any listing/advertisements on your behalf that may have ceased to be relevant to our users for example, because a system leader is no longer available.
  4. Listings submitted to our website will be automatically processed / individually reviewed and will usually be published within 48 hours (the only exceptions to this are weekends, bank holidays, Christmas & Easter when it may take longer to approve your account and make your listing live).
  5. Without prejudice to our other rights under these terms and conditions, we reserve the rights to reject, unpublish or delete listings/advertisements that breach these terms and conditions or that do not meet any additional guidelines for submissions published on our website. 
  6. Inclusion in our directory, in no means indicates an endorsement from us, we urge anyone using the directory to source support to do the necessary background research before enlisting the help/support from an organisation/individual/company listed in our directory. CPD Portal cannot be held responsible for any damages as a result of its directory.
  7. If we accept your listing submission, then it will remain published on our website for a period of the time agreed subject to these terms and conditions.

SECTION 3 : Prohibited Uses

  1. You may use our site only for lawful purposes.  
  2. You may not promote violence against or directly attack or threaten other people on the basis of race, ethnicity, national origin, sexual orientation, gender, gender identity, religious affiliation, age, disability, or disease.

                    ·  In any way that breaches any applicable local, national or international law or regulation.

                    ·  In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect

                    ·  For the purpose of harming or attempting to harm persons in any way or through any Hateful Conduct:

  1. You may not promote violence against or directly attack or threaten other people on the basis of race, ethnicity, national origin, sexual orientation, gender, gender identity, religious affiliation, age, disability, or disease.

                    ·  To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).

                    ·  To knowingly transmit any data, send or upload any material that contains viruses or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

  1. You also agree:

                    ·  Not to reproduce, duplicate, copy or re-sell any part of our site.

                    ·  Not to access without authority, interfere with, damage or disrupt:

                    -       any part of our site;

                    -       any equipment or network on which our site is stored;

                    -       any software used in the provision of our site; or any equipment or network or software owned or used by any third party.

SECTION 4 : Suspension and Termination

  1. We will determine, in our discretion, whether there has been a breach of our terms and conditions through your use of our site.  When a breach has occurred, we may take such action as we deem appropriate. 
  2. Failure to comply with our terms and conditions constitutes a material breach of the terms of use upon which you are permitted to use our site, and may result in our taking all or any of the following actions:

                    · Immediate, temporary or permanent withdrawal of your right to use our site.

                    · Immediate, temporary or permanent removal of any posting or material uploaded by you to our site.

                    · Issue of a warning to you.

                    · Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.

                    ·  Further legal action against you.

                    ·  Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

  1. We exclude liability for actions taken in response to breaches of our terms and conditions.  The responses described in our terms and conditions are not limited, and we may take any other action we reasonably deem appropriate.

Changes to our Directory Terms of Use

We may revise our terms and conditions at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you. Some of the provisions contained in our terms and conditions may also be superseded by provisions or notices published elsewhere on our site.

We require this information to understand your needs and provide you with a better service, and in particular for the following reasons:

  • Internal record keeping and invoicing.
  • We may use the information to improve our products and services.
  • We use the contact information you enter when booking/registering on an event to communicate with you on legitimate interest grounds eg. booking confirmation(s) and operational communications regarding the event. 
  • We may periodically send promotional emails about new products, special offers or other information which we think you may find interesting using the email address which you have provided.
  • From time to time, we may also use your information to contact you for market research purposes. We may contact you by email, phone, fax or mail. We may use the information to customise the website according to your interests.

Controlling your personal information

You may choose to restrict the collection or use of your personal information in the following ways:

  • By agreeing to the Teaching School Hub Portal's Privacy Policy you consent to receiving emails (Booking Confirmation, Operational Issues and Invoices) regarding events you have booked onto. You will not be able to book unless you agree to the privacy policy. 
  • Each time you book onto an event you are required to set your email communication preferences for news and promotions sent from the service about the Teaching School Hub Portal.
  • If you have previously agreed to us using your personal information for direct marketing purposes, you may change your mind at any time by writing to or emailing us  or by updating your communication preferences when booking an event.
  • We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so. 
  • You may access and view the your personal information stored about you by the service. To access access this data, log into your account and the 'My Bookings' menu. From here you can view the data stored about you. If you require help please contact us here.
  • If you believe that any information we are holding on you is incorrect or incomplete, please contact us as soon as possible, please contact us here and we will promptly correct any information found to be incorrect.

Retention

If you register with us, we shall retain your personal data until you request to close your account. If you receive marketing communications from us, we shall retain your personal data until you opt out of receiving such communications.

If you have otherwise booked an event with a provider or contacted us with a question or comment, we shall retain your personal data for 6 months following such contact to respond to any further queries you might have.


Right to be Forgotten

Under GDPR you have the right to be forgotten, please contact us here to request deletion of your account and all personal information stored on you (as well as any backed up data). 


Security

We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.

All data is stored within the EU and is spread across 3 data centres for redundancy. The continous monitoring, upgarding and securing of the servers is performed by a qualified team of system administrators.

Where we have given, or you have chosen a password, you are responsible for keeping this password confidential.

However, you acknowledge that no system can be completely secure. Therefore, although we take these steps to secure your personal data, we do not promise that your personal data will always remain completely secure. 

 

How we use cookies

Overall, cookies help us provide you with a better website, by enabling us to monitor which pages you find useful and which you do not. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us.

Information for Event 'Bookers'

Teaching School Hub Portal-SW is a “self-service” platform where Event Bookers can book their attendance on events. When you book onto an event directly, your commercial agreement is entirely with the event provider. Teaching School Hub Portal-SW does not manage or control any of the listings or events on our website and beyond providing the software services to promote and manage events online we do not have any affiliation with the event provider, venue or event.

If you have any questions about an event, booking, refunds, data privacy or terms and conditions please contact the Event Provider directly via the ‘Contact’ menu on the relevant CPD Sub Regional site, selecting the provider you wish to contact. You may also find contact details for them in the same place you found the original link for their event (e.g. their website, Facebook page, or Twitter account).

Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, or you have invited team members to access parts of our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone. You should reset your password periodically; you can do this by logging in and resetting your password. Your password should be unique and not a derivative of an existing one. 

As an Event Booker you are subject to the Teaching School Hub Portal SW's Privacy Policy and Terms of Use as well as the Terms and Conditions of the Event Provider, and by using the service you accept the terms and conditions.

Info for Event 'Providers' 

Teaching School Hub Portal-SW is a “self-service” platform where event providers manage their own event listings, and customer bookings entirely. When you book onto an event directly your commercial agreement is entirely with the event provider. Teaching School Hub Portal-SW does not manage or control any of the listings or events on our website and beyond providing the software services to promote and manage events online we do not have any affiliation with the event provider, venue or event.

When you (as an Event Organiser) use the Teaching School Hub Portal  for promoting events and collecting data from your attendees you are the “data controller” of all your attendees’ data. Teaching School Hub Portal-SW is a “data processor”, which means that the Teaching School Hub Portal won’t do anything with your attendees’ data other than what you need the the Teaching School Hub Portal to do in order to provide the service. The Teaching School Hub Portal-SW will not send attendees any marketing emails or share their data with anyone. 

The Event Organiser is responsible for the security and their GDPR compliance in the use of any data exported from the Teaching School Hub Portal-SW and should adhere to their own organisation's policy and practice. 

The Teaching School Hub Portal cannot be held responsible for any data breach relating the mishandling of data / data exported from the system by an Event Organiser. 

The Teaching School Hub Portal provides the ability for Event Organisers to email event delegates directly through the system. This functionality has been designed to send service related (operational) emails specific to an Organiser's event attended by the recipient of such email. If an Organiser wants to use this function for marketing purposes, you (the Organiser) need to secure your own compliant opt-in consents for the sending of marketing emails. Each event provides event attendees with the option to set their communication preferences.

If  an event attendee/booker should have any questions about an event, booking, refunds, data privacy or terms and conditions they should contact the event organiser directly via the ‘Contact’ menu on the relevant CPD Sub Regional Booking site, selecting the provider they wish to contact. They may also find contact details for them in the same place they found the original link for their event (e.g. their website, Facebook page, or Twitter account).

All intellectual property, including page layouts, navigational layouts, event booking, directory, logo and branding lies with In-finity Solutions . All Enhancements to the site's core extensions remain solely the property of In-Finity Solutions.

In-Finity Solutions owns the copyright to the content listed on Teaching School Hub Portal's pages excluding the Directory and CPD Catalogue. CPD event content submitted to the Teaching School Hub Portal (e.g. content promoting an event, event description and logos) remains the copyright of the CPD Provider Organisation.

Our status (and that of any authorized contributors) as the authors of content on our website must always be acknowledged. 

You must not use any part of the content on our website for commercial purposes without obtaining a licence to do so from In-Finity Solutions first. 

 


5. Limitation of liability

 

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our Website or any content on it, whether expressed or implied.

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence) breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • Use of or reliance on any content displayed on our Website.

We will not be liable for: 

  • Loss of profits, sales, business or revenue;

You are responsible for configuring your information technology, computer programmes and platform in order to access our Website. You should use your own virus protection software. 

You are prohibited from posting or transmitting to or from the Website any material:  

  •  that is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence or in breach of privacy; or

  • which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party, in any country in the world; or

You may not misuse the Website (including, without limitation, by hacking).

9. CPD Event Providers 

Teaching School Hub Portal is a “self-service” platform where CPD Event Providers can manage and promote their own event listings. When you book onto an event directly your commercial agreement is entirely with the event provider. Teaching School Hub Portal does not manage or control any of the listings or events on our website and beyond providing the software services to promote and manage events online we do not have any affiliation with the event provider, venue or event.

When you (as an Event Organiser) use the Teaching School Hub Portal  for promoting events and collecting data from your attendees you are the “data controller” of all your attendees’ data. 9.1 Event Deletion 

In order to avoid having to restore your events after deletion and introducing an overhead, we don't currently provide this functionality. Instead of deleting a event you  can 'Unpublish' the event and it will be hidden. If you require the event permanently deleted from the platform we can of course delete it for you. Please contact us if you require an event deleted. 


9.2 Event Expiry

Events where the end date has expired will be removed from the platform. Once they have been deleted from the system it is not possible to recover them.  

Please contact us if you wish to retain an expired event before the event’s end date.
 

10. Directory Listings

  1. We welcome listing submissions to the directory published on our website.
  2. Each submission to our directory must be a listing in respect of an organisation's desgination as a Teaching School Hub.
  3. For the avoidance of doubt, your directory submissions constitute "your content" and must comply with the acceptable use rules set out in our Directory Terms of Use 
  4. You agree to keep your directory submissions up to date at all times. Please use the 'Report' button next to your listing to report it to us.
  5. It is your responsibility to identify and advise us of any errors regarding your listing.
  6. We will delete a directory listing should an organisation's subscription lapse.
     

11. Canceling a subscription order

Subscription orders for the Teaching School Hub Portal placed directly with In-Finity Solutions are processed immediately and can only be canceled by contacting us here (you have a 'cooling off' period of 24 hours after sign up). All prices are per annum and exclude VAT. Please ensure you have authorisation to sign your orgnisation up to the platform. If you decide you no longer wish to use or retain access to the service to which you've subscribed including your organisation's listing in our directory and CPD catalogue, you must contact us to request cancellation within 30 days of the subscription expiry date (the expiry date is 12 months from the date the subscription was taken out). Failure to inform us you wish to cancel within the agreed time will result in you being billed for the next year’s membership.


11.1 Access to Data

You will have access to files uploaded to your account and your events for 30 days after the subscription end date. After 30 days, your account will be disabled and become inaccessible and all your events will be deleted from the platform.  


11.2 Subscription Renewal

Your subscription automatically renews when your contract expires to ensure you have continuous access to the platform (You will be invoiced 60 days before your renewal date). You will be charged for a new subscription term on the renewal date listed in the ‘My Subscriptions’ menu. 

You can cancel the automatic renewal within 30 days of your renewal date by contacting us here. You will retain access to the platform and its services until the renewal date but will not be automatically charged for a new subscription if you fail to inform us you wish to cancel. Access to the platform and any services will end on your subscription renewal date.
 

12. Applicable law

These terms of use, its subject matter and its formation (and any non-contractual dispute or claim) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

CPD Portal is a “self-service” platform where Event Bookers can book their attendance on events. When you book onto an event directly, your commercial agreement is entirely with the event provider. CPD Portal does not manage or control any of the listings or events on our website and beyond providing the software services to promote and manage events online we do not have any affiliation with the event provider, venue or event.

If you have any questions about an event, booking, refunds, data privacy or terms and conditions please contact the Event Provider directly via the ‘Contact’ menu, selecting the provider you wish to contact. You may also find contact details for them in the same place you found the original link for their event (e.g. their website, Facebook page, or Twitter account).

Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, or you have invited team members to access parts of our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone. You should reset your password periodically; you can do this by logging in and resetting your password. Your password should be unique and not a derivative of an existing one. 

As an Event Booker you are subject to the CPD Portal's Privacy Policy and Terms and Conditions, and by using the service you accept the terms and conditions. 


Event Deletion 

In order to avoid having to restore your events after deletion and introducing an overhead, we don't currently provide this functionality. Instead of deleting a event you can 'Unpublish' the event and it will be hidden. If you require the event permanently deleted from the platform we can of course delete it for you. Please contact us if you require an event deleted. 


Event Expiry

Events where the end date has expired will be removed from the platform. Once they have been deleted from the system it is not possible to recover them.  

Please contact us if you wish to retain an expired event before the event’s end date.

CPD Portal is a “self-service” platform where event providers manage their own event listings, and customer bookings entirely. When you book onto an event directly your commercial agreement is entirely with the event provider. CPD Portal does not manage or control any of the listings or events on our website and beyond providing the software services to promote and manage events online we do not have any affiliation with the event provider, venue or event.

When you (as an Event Organiser) use the CPD Portal  for promoting events and collecting data from your attendees you are the “data controller” of all your attendees’ data. CPD Portal is a “data processor”, which means that the CPD Portal won’t do anything with your attendees’ data other than what you need the the CPD Portal to do in order to provide the service. The CPD Portal will not send attendees any marketing emails or share their data with anyone. 

The Event Organiser is responsible for the security and their GDPR compliance in the use of any data exported from the CPD Portal and should adhere to their own organisation's policy and practice. 

The CPD Portal cannot be held responsible for any data breach relating the mishandling of data / data exported from the system by an Event Organiser. 

The CPD Portal provides the ability for Event Organisers to email event delegates directly through the system. This functionality has been designed to send service related (operational) emails specific to an Organiser's event attended by the recipient of such email. If an Organiser wants to use this function for marketing purposes, you (the Organiser) need to secure your own compliant opt-in consents for the sending of marketing emails. Each event provides event attendees with the option to set their communication preferences.

If  an event attendee/booker should have any questions about an event, booking, refunds, data privacy or terms and conditions they should contact the event organiser directly via the ‘Contact’ menu, selecting the provider they wish to contact. If you wish to report misuse of the system or you suspect a fraudulent event listing please send the details via the contact form and include a link to the event.
